House Rules

THE TENANCY CREATED BY THIS AGREEMENT IS GOVERNED BY THE RESIDENTIAL TENANCIES ACT AND IF THERE IS A CONFLICT BETWEEN THE AGREEMENT AND THE ACT, THE ACT PREVAILS.

Alberta Residential Lease Agreement

Between;

Gordon James (also referred to as Landlord, or my)

And

“Guest” (also referred to as Tenant, or you, or your)

FIXED TERM LEASE AGREEMENT (this “Agreement”) - Jonah Porter does demise and lease unto the Tenant the property in its entirety as described in the listing (the “Property”) for the exclusive possession of the Tenant for a fixed term outlined in the agreed upon and accepted “Booking Confirmation”. The terms and conditions contained in the listing for the Property and the Booking Confirmation are incorporated into, and form an essential part of, this Agreement. In the event there is any conflict between this Agreement and the listing for the Property or the Booking Confirmation, the terms of this Agreement will prevail.

OFFLINE SECURITY DEPOSIT REQUIRED
$500 or not to exceed one month’s rent.

CONDITIONS AND TERMS OF TENANCY;
All public health orders in place at the time of tenancy must be followed, including any applicable masking or face covering requirements.

FUNDAMENTAL USES - ONE FAMILY UNI (Website hidden by Airbnb)
The unit shall only be occupied by the tenant of the owner, and the tenant’s family and guests. No Unit shall be used in whole or in part for any commercial or professional purpose involving the attendance of the public at such Unit and without limiting the generality of the foregoing, no Unit or part thereof shall be used as an office by a doctor, dentist, chiropractor, drug less practitioner, or other professional person, except as otherwise authorized by the board in writing, which approval may be arbitrarily withheld and if given, by withdrawn at any time on thirty (30) days notice.

UNDERTAKING BY TENANT(S)
Throughout the Term, Tenant covenants that it shall comply with the provisions of the Act and of all bylaws and the rules and regulations of the Condominium Corporation, as adopted from time to time, insofar as such provisions affect Tenant and occupier of the Premises. Tenant acknowledges that Landlord, as owner of the Premises, retains all rights, privileges and powers under the Act and all bylaws, rules and regulations of the Condominium Corporation, including, without limitation, the right to vote and to settle, determine, resolve and pass any amendment(s) or substitution(s) to the bylaws, rules and regulations of the Strata Corporation from time to time, without notice to Tenant. A copy of the condominiums bylaws will be provided electronically and a hard copy has been laminated within the unit.

PETS
No animal, livestock, fowl, or reptile (all of the foregoing hereinafter referred to as a “pet’) of any kind exceeding 30” tall at it’s shoulders shall be kept in any unit. Consent, approval and a non-refundable pet deposit of $40 per day will apply (Website hidden by Airbnb) TENANT(S) INSURANCE
Tenant(s) shall obtain, maintain and keep in force during the Term, including any extension thereof, Tenants Basic Form or the Tenants Comprehensive Form, together with Personal Liability insurance.

DAMAGES
Any damage made to the Property between move-in and move-out (“Damage”) will be noted and documented on the units Inspection Report. The Tenant will be contacted regarding any repair, or replacement required as a result of the Damage and will be responsible for all costs associated with the repair or replacement.

AUDIO/VIDEO/STILL CAMERA SECURITY CAMERAS AND RECORDING DEVICES
Shielding, covering or intentionally interfering with these Audio/Video/Still Image recording devices will be treated as a substantial breach by the tenant. Please consider all of the following devices actively record 24 hours, 7 days a week for the safety and security of all building’s community members, including the tenant(s). The common areas are monitored via video and audio cameras by the condominium corporation.
Minut decibel monitors are located in the Property. These sensors monitor the noise level in the Property, but do not record audio. This means the devices detect issues in real time, keeping the Property safe and the relationship with my neighbors strong, all while protecting your privacy.

ONE-FAMILY UNIT USE ONLY
ALL PUBLIC HEALTH ORDERS MUST BE FOLLOWED.
NO SMOKING / VAPING OR DRUG USE. ($500 Smoke Remediation)
QUIET ENJOYMENT - NO EXCESSIVE OR UNDUE NOISE to exceed 15 dB on the C Scale between the hours of 11pm and 8am and; 30 dB on the C Scale between the hours of 8am and 11pm.

HOST LIABILITY
The Host will in no way be liable or responsible for any damage, however caused, to any property belonging to or owned by the Tenant, by other tenants, or by visitors to the Property while such property is located upon the Property. The Host will in no way be liable or responsible for any personal injury or death that may be suffered or sustained by the Tenant, other tenants or visitors.

ASSIGNMENT AND SUBLETTING
The Tenant shall not assign this Agreement, the fixed term hereby granted, or any part thereof, nor leave any other tenant or visitors in charge of the Property.
